Background

This LeagueApps™ Youth Registrant Privacy Policy (“Youth Registrant Privacy Policy”) applies to LeagueApps™ users who are between the ages of thirteen (13) and eighteen (18) years old (“Youth Registrants”).  Youth Registrants who have been authorized by their coach/league, as well as one of their Parents, can access the LeagueApps™ App, the associated Content and the associated features.  Please note, Youth Registrants are not permitted to use the LeagueApps™ website located at https://leagueapps.com (the “Site”).

This Youth Registrant Privacy Policy is a part of the general LeagueApps™ Privacy Policy (“General Privacy Policy”). Capitalized words that are not defined in this Youth Registrant Privacy Policy shall have the meanings described in the General Privacy Policy.  Where there is a conflict between any provisions in this Youth Registrant Privacy Policy and any provisions in the General Privacy Policy, the provisions in this Youth Registrant Privacy Policy shall apply.

LeagueApps™ is committed to respecting your privacy and recognizing your need for appropriate protection and management of your personally identifiable information. The purpose of this Youth Registrant Privacy Policy is to explain: (1) the types of information LeagueApps™ obtains about Youth Registrants; (2) how the information is obtained; (3) how it is used; (4) the choices you have regarding our use of the information; and (4) your ability to review and correct this information.

Please read this Youth Registrant Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you do not have permission to access and/or use the LeagueApps™ App.

Parents

This Youth Registrant Privacy Policy is implemented in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”), and outlines our practices regarding the collection, use and sharing of Youth Registrant and Child personal information. Children Under Thirteen (13) Years of Age

If you are under thirteen (13) years of age (a “Child”), you are not permitted to provide any information by and through the Site, App and/or Services (including any information about yourself, such as your name, address, telephone number, e-mail address or any screen name or user name that you may use). Only Parents may create an account for leagues involving, and/or submit information about, sports registrants under thirteen (13) years of age.  LeagueApps™ does not solicit or collect personal information from individuals under thirteen (13) years of age. If we learn that we have collected or received personal information from an individual under thirteen (13) years of age from any individual other than a Parent as permitted under our Terms of Service, we will delete that information and any related account.

Your State Specific Privacy Rights

Youth Registrants (including residents of the States of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia) have additional rights with respect to their personal information. Please see our “Privacy Provisions for Covered Users” in the General Privacy Policy for a more complete description of your rights as a Covered User.

What Information We Collect

We do not collect any personal information directly from Youth Registrants or Children under thirteen (13) years of age.  Where a Youth Registrant registers for a Youth Registrant Account with the permission of her/his/its Parent, her/his/its Parent will provide us with that Youth Registrant’s full name and email address.

We do, under certain circumstances, collect information that cannot be used to identify Youth Registrant’s personally, which we refer to as “non-personally identifiable information.”

Where the applicable Parents have provided consent in advance, we may collect certain non-personally identifiable information about Youth Registrants and Youth Registrant mobile devices when Youth Registrants access the App and visit certain App pages. This non-personally identifiable information includes: (1) mobile device platform type; (2) mobile device identifier; (3) SDK version; (4) API key (identifier for the App); (5) App version; (6) the model type, manufacture and Android version of the applicable Youth Registrant’s mobile device; (7) the applicable App session start/stop time and date; and (8) the actions taken while utilizing the App.

We only use the non-personally identifiable information identified in the above paragraph to: (A) improve the design and content of the App, our Site and the associated Services; (B) to enable us to personalize your App experience; and (C) to analyze App usage, alter existing Services and/or develop new or different Services.  LeagueApps™ does not use geolocation technology to track your location.

Further, LeagueApps™ may collect and track metrics and performance statistics relating to use of the App on a strictly anonymized and non-personally identifiable basis. LeagueApps™ may use these metrics and statistics to generate analytics to improve our Services and other offerings. This information may include, but is not limited to: (i) the IP address and physical location of the devices accessing the App; (ii) the time and date of each access and the amount of time spent on certain sections of the App.

How We Use Your Personal Information

We only use personal information about Youth Registrants to: (1) provide Youth Registrants with the features and functions of the App and/or the Services; (2) communicate with the Youth Registrants regarding their respective Youth Registrant Accounts; (3) provide Youth Registrants with superior service and with information about their respective organizations; (4) provide Youth Registrants with a personalized experience while using our App and/or Services.  We may also send push notifications about Youth Registrant sports organizations/teams by and through Youth Registrants’ mobile devices.

How We Share Your Personal Information with Third Parties

We do not share or sell Youth Registrant/Child personal information for financial gain or marketing purpose under any circumstances.  We only share Youth Registrant/Child personal information for valid business purposes and under special circumstances as set forth below:

Service Providers: We may use other companies to perform services including, without limitation, facilitating some aspects of our App or Services, such as sending emails and fulfilling customer service requests. These other companies may be supplied with or have access to Youth Registrant personal information solely for the purpose of providing these services to Youth Registrants on our behalf.

Special Circumstances: We also may disclose Youth Registrant information, including personally identifiable information, in the following circumstances:

    • (1) In response to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency; (2) To establish or exercise our legal rights; (3) To defend against legal claims; or (4) As otherwise required by law;
    • (1) When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; (2) To protect and defend the rights, property or safety of our company, our users, our employees, or others; (3) To comply with applicable law or cooperate with law enforcement; or (4) To enforce our App terms and conditions or other agreements or policies.
    • In connection with a corporate transaction, such as the sale of all or a portion of our business, or a merger with another company (collectively, “M&A Transactions”), or if we are the subject of bankruptcy proceedings. We will endeavor to contact Parents in the event that LeagueApps™ is involved in a bankruptcy proceeding or an M&A Transaction of any change in ownership or uses of Youth Registrant personal information, as well as any choices that Parents/Youth Registrants may have regarding their personal information.

We may also share aggregated, non-personally identifiable information publicly, including with partners or the press in order to, for example, demonstrate how our Services are used, evaluate industry trends, or to create our marketing materials. Any aggregated information shared this way will not contain any personal information.

How to Delete Youth Registrant or Child Personal Information

At any time, a Parent can request that we delete from our records the personal information we have collected in connection with their Youth Registrant or Child.  Any Youth Registrant that wishes to delete her/his/its personal information should request that their Parent make the request on their behalf.  Please keep in mind that a request to delete records of a Youth Registrant may lead to termination of the applicable Youth Registrant Account.

We use two methods to allow Parents to delete Youth Registrant or Child personally identifiable information:

  1. Parents can request access to and delete Youth Registrant and/or Child personal information by logging on to the Parents’ Member Account and following the prompts in the Member Account interface.
  2. Parents can contact LeagueApps™ to request to update or delete Youth Registrant and/or Child personal information by sending an email to us at: privacy@leagueapps.com, calling us at: (800) 257-3681 or sending us U.S. Mail to: LeagueApps, Inc., 30 Irving Place, 3rd Floor, New York, NY 10003. A valid request to delete personal information will be accommodated within a reasonable period of time.

In any correspondence such as e-mail or mail, please include the Youth Registrant’s/Child’s name and, for Youth Registrants, their email address (if applicable), as well as the Parent’s name, email address and telephone number. To protect the privacy and security of Youth Registrant and Child personal information, we will take reasonable steps to help verify a Parent’s identity before granting access to any Youth Registrant personal information.

Once we receive and confirm a Parent’s verifiable request, we will delete the applicable Youth Registrant’s/Child’s personal information.

Please note, we may deny such a deletion request if retaining the information is necessary for us or our service providers to:

  1. Provide the good or service that you requested.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
  3. Comply with a legal obligation.

Access to Specific Information and Data Portability Rights

At any time, a Parent can request that we disclose certain information to that Parent about our collection and use of the personal information of their Youth Registrant and/or Child over the past twelve (12) months.  Any Youth Registrant that wishes to obtain such information should request that their Parent make the request on their behalf.  A Parent can complete such a request by sending an email to us at: privacy@leagueapps.com, calling us at: (800) 257-3681 or sending us U.S. Mail to: LeagueApps, Inc., 30 Irving Place, 3rd Floor, New York, NY 10003.

In any correspondence such as e-mail or mail, please include the Youth Registrant’s/Child’s name and, for Youth Registrants, their email address (if applicable), as well as the Parent’s name, email address and telephone number. To protect the privacy and security of Youth Registrant and Child personal information, we will take reasonable steps to help verify a Parent’s identity before granting access to any Youth Registrant personal information.  Once we receive and confirm a Parent’s verifiable request, we will disclose to that Parent the following:

  • The categories of personal information we collected about the applicable Youth Registrant/Child.
  • The categories of sources for the personal information we collected about the applicable Youth Registrant/Child.
  • Our business or commercial purpose for collecting that personal information and disclosing same, where applicable.
  • The categories of third parties with whom we have shared that personal information.
  • The specific pieces of personal information we collected about the applicable Youth Registrant/Child (also called a data portability request).

How to Update or Modify Youth Registrant and/or Child Personal Information

At a Parent’s request, we will amend/update the personal information that we have on file for their Youth Registrant and/or Child. Any Youth Registrant that wishes to amend/update their personal information should request that their Parent make the request on their behalf.

A Parent can complete such a request by sending an email to us at: privacy@leagueapps.com, calling us at: (800) 257-3681 or sending us U.S. Mail to: LeagueApps, Inc., 30 Irving Place, 3rd Floor, New York, NY 10003.

In any correspondence such as e-mail or mail, please include the Youth Registrant’s/Child’s name and, for Youth Registrants, their email address (if applicable), as well as the Parent’s name, email address and telephone number. To protect the privacy and security of Youth Registrant and Child personal information, we will take reasonable steps to help verify a Parent’s identity before granting access to any Youth Registrant personal information.  Once we receive and confirm a Parent’s verifiable request, we will make the applicable update/correction/modification.

Appealing A Request Denial

If we deny a Parent any access/right to know, data portability, right to correct and/or deletion rights request, that Parent may submit an appeal of our decision within thirty (30) days of that Parent’s receipt of our notice of denial by e-mailing us at: privacy@leagueapps.com, calling us at: (800) 257-3681 or sending us U.S. Mail to: LeagueApps, Inc., 30 Irving Place, 3rd Floor, New York, NY 10003.

Opt-Out/Unsubscribe

To opt-out of a Youth Registrant receiving App-based push notifications and other forms of communication from their applicable team/league/league operator, Parents can: (1) follow the instructions included in the applicable e-mail message or other communication; (2) use their respective account interface; or (3) e-mail us at: privacy@leagueapps.com.

Youth Registrant Messaging

Youth Registrants may be able to access Interactive Services that allow Youth Registrants to communicate directly with the applicable coaches/league operators of the sports organization that they are registered with (collectively “Youth Registrant Messaging”).  Parents shall be able, at all times, to access the logs of any and all Youth Registrant Messaging involving their Youth Registrants.  If a Parent suspects any inappropriate behavior and/or discussions in connection with any Youth Registrant Messaging, the Parent should contact LeagueApps and the applicable authorities immediately. 

Youth Registrants should not make any personal information available in their Youth Registrant Messaging sessions. We are not responsible for the personal information that any Youth Registrant chooses to submit via Youth Registrant Messaging.

Links to Third Party Sites and/or Integration with Third Party Platforms

The App and/or Services may interface with third party websites and services (for example, social media platforms like Facebook®, Twitter®, Google+® or other third party applications, sites or services), over which we have no control.

Privacy policies for these third party sites and services may be different from this Youth Registrant Privacy Policy and our General Privacy Policy. You access these third party sites and services at your own risk. You should always read the privacy policy of a linked site or integrated service before disclosing any personal information on such site and/or through such service. LeagueApps™ is not responsible for information that you submit to third parties or through third party platforms.

Accessing the App from Outside the United States

We store and process all personal information for LeagueApps™ within the USA.  If you are visiting the App from outside the United States, please be aware that your information will typically be transferred to, stored and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. Please be assured that we seek to take reasonable steps to ensure that your personal information is protected. By using the App, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Youth Registrant Privacy Policy and our General Privacy Policy.

Furthermore, with respect to any personal information originating outside the U.S., we will retain such information until we determine that you are no longer active within our system.

Privacy Policy Changes

This Youth Registrant Privacy Policy may change from time to time. To improve the services and opportunities that we can offer you, LeagueApps™ may opt to expand our capabilities for obtaining information about users in the future. LeagueApps™ will update this Youth Registrant Privacy Policy continually to ensure that you are aware of developments in this area. We will post those changes in the App so that you will always know what information we collect through the App and/or Services, how we use that information, and what choices you have with respect to same.

Your continued use of the App after we make changes is deemed to be acceptance of those changes; provided, however, that if the manner in which we use Youth Registrant personal information changes, LeagueApps™ will notify the Parents of Youth Registrants by: (1) sending the modified policy to the Parents and Youth Registrants via e-mail; and/or (2) by any other reasonable means acceptable under applicable state and federal law. Parents and Youth Registrants will have a choice as to whether or not we use the information of Youth Registrants information in this different manner and we will only use that information in this different manner where both the Parents and Youth Registrants opt-in to such use.
